I just don't want him to keep building credit if I am the one paying the rent.



We are breaking up if it wasn't obvious.

yep but he has to agree to move and they must want to keep you.can you afford it?

If you're in good standing with your Landlord and can afford the rent on your own you will probably be able to stay. Talk to your Landlord and see what he/she says. I hope you don't have any joint accounts with your soon to be ex, such as credit cards or gym memberships. That causes nothing but trouble when a couple breaks up. If there are no other issues, you shouldn't have a problem remaining in your apartment.

yes he can get removed from the lease. Make sure you get it all in writting and signed with your landlord. If you can afford it do it. Get him off there.

Have your landlord draw up a new lease dated the day he moved out.

Yes, I've broken a lease twice (once under your exact circumstances). It requires him notifying your landlord of an intent to vacate. You will may have to qualify for the place (through whatever means that your landlord qualified the two of you together) by yourself and more than likely sign something that states that you, and solely you, resume responsibility for the remainder of the lease, or the landlord may have you sign a new lease. Now, your ex may have to pay some sort of penalty (in my case there were none), but that would depend on who your renting from. 1-2 months rent is the standard with 30-60 days notice.
